If the frequent collapse of the provincial coalition in Kosi is any indication, all is not well in the power dynamics in Nepal’s nine-party governing alliance.
This week, Kedar Karki of Nepali Congress (NC) became the fifth Chief Minister of Kosi Province since elections last November. Karki passed the floor test in the provincial assembly, but with help from the opposition UML. The UML had failed to get enough votes for its own chief minister candidate which precipitated the new election.
This was an embarrassment for Maoist prime minister Pushpa Kamal Dahal who had got the coalition at the centre to back fellow comrade Indra Bahadur Angbo. And it was also a blow to NC president Sher Bahadur Deuba.
A dissident faction of the NC not happy with party president Sher Bahadur Debut’s conjugal relationship with the Maoists, got UML backing to support Karki’s chief ministership. Eight NC members from Koirala’s camp and 39 from the UML, which has the majority seats in Kosi provincial assembly, supported Kedar Karki.&nbsp;
What followed was even more intriguing. Prime Minister Dahal and Deuba summoned Shekhar Koirala and tried to convince him to backtrack on Kosi. He refused. But they did manage to convince him not to mess with the coalition setup in return for allowing Karki to be Kosi Chief Minister.
And since Nepali leaders are not best known to keep their word, the three put their deal in writing on a crumpled piece of paper, torn from someone’s copy book, and signed it (pictured).
Kathmandu interfering in Kosi is not new. In fact, the former Kosi Chief Minister Hikmat Karki of the UML was actually backed by the Maoists, despite its alliance with the NC at the centre. Rescinding that support is what led to the current instability.&nbsp;
The background to this back-and-forth is the ethnic debate about whether the province should be called Kosi or Kirat. The matter is such a hot potato that Province 1 was the last of the seven to finally vote on a name (Kosi) last year.&nbsp;
The region’s indigenous groups want a name that reflects their identity, but the various ethnic groups are not united in what that name should be. Prime Minister Dahal made matters more complicated by saying that Kosi should be changed to Kirat.&nbsp;
All this is ammunition for those who want to scrap Nepal’s federalism, saying it is a waste of money, it decentralises corruption and multiplies by seven the disarray at the centre.
However, Nepal’s provinces have never been allowed true autonomy on revenue-raising and decision-making, they have been mere appendages of Kathmandu.
Within the NC, the Kosi debate has brought to the surface the strong feelings about the leadership of the largest party in Parliament shamelessly kowtowing to the third largest party. Leading this dissenting group are Shekhar Koirala and Gagan Thapa, although there is an undercurrent of rivalry to succeed Deuba between them.
So far, the coalition has withstood tensions brought on by controversial provisions in the budget, as well as a series of high profile corruption cases that shook up and implicated the top leadership of all major political parties.&nbsp;
It is clear that Nepal’s governing coalition, especially the alliance between the NC and the Maoists, has remained steadfast because of the sheer opportunism of the leaders in charge of both the parties. (And perhaps a bit of geopolitical goading from the South.)
The aftermath of Dahal’s successful attempt to regain premiership from Deuba last year was a power-sharing deal under which Dahal and Deuba gave each other two years each as PM. As per the deal, Unified Socialist chair Madhav Nepal also gets one year at premiership, which is perhaps why he has gone along with the whims of Dahal and Deuba.
All this horse-trading leaves little time for the coalition to govern. Development is at a standstill, inflation is at an all time high (page 4) and corruption has reached pandemic proportions.&nbsp;
The Dasain mood is subdued. Coalition partners will likely use the holiday to plot, and plot some more. They will face fresh challenges, the biggest being the question whether the alliance will hold together long enough, and if Deuba and Dahal will honour their deal to rotate the prime ministership.

Finance Minister Bishnu Paudel, Naryan Kaji Shrestha and Rajendra Lingden, all three of whom are deputy prime ministers, were not present at the meeting.Foreign Minister Bimala Rai Paudyal and Health Minister Padam Giri both spoke up against Dahal’s decision. Dahal struck while the iron was hot, when he knew that there would be little opposition from within his coalition and the opposition to his decision because of the forthcoming election for president.The largest party in Parliament, the Nepali Congress (NC) is in the opposition but has given tacit support to Dahal’s government. The second largest party, the UML is in the coalition. The NC has also been singled out, since its party members were especially targeted by the Maoists for execution and torture during the conflict.Besides those killed, 3,125 people are still listed as missing during the conflict, tens of thousands were maimed for life and millions were displaced from their homes. There are thousands of testimonies submitted to the formation of the Truth and Reconciliation Commission and the Commission on Enforced Disappearances, but none of the atrocities committed by state security and the rebels have ever been investigated.Even the phrase ‘People’s War’ has been rejected by the Supreme Court as an official description of the Maoist insurrection. Uproar over Maoist war anniversary holiday

Which is why the smaller members of the governing alliance are getting <a href="https://www.nepalitimes.com/banner/dance-of-democracy/" target="_blank" rel="noopener noreferrer">cold feet</a>.The UML and Maoist alliance swept the 2017 federal and provincial elections, but the Nepal Communist Party has since splintered, with the UML also breaking in two. All this is good news for the NC.Party alliances are less important in local elections, which is why <a href="https://www.nepalitimes.com/banner/can-nepal-elections-change-its-male-stream-politics/" target="_blank" rel="noopener noreferrer">women and new voters</a> who are not loyal to any parties will be making their presence felt in May.“We have seen that 75-80% of voters close their eyes and cast their ballots out of party loyalty, but 25-30% vote independently,” says former Chief Election Commissioner Bhojraj Pokharel. “These silent voters will be decisive in a close election.”There was an indication of this trend in the 2017 Kathmandu mayoral race, when the relatively unknown <a href="http://archive.nepalitimes.com/blogs/thebrief/2017/05/19/the-ranju-darshana-phenomenon/" target="_blank" rel="noopener noreferrer">Ranju Darshana </a>of the alternative Bibeksheel Party came out of nowhere to get the third highest number of votes.“I think there are more and more voters who do not fall for the false promises of established parties and feel free to vote with their conscience,” says Kishor Thapa, also a mayoral candidate from the Sajha Party in the Kathmandu polls in 2017.The trend has always been that while political parties command vote banks during national elections, many vote independently during local polls. There were many cases in the municipal and ward voting in 2017 where party alliances did not ensure victory for candidates.“Political parties are making grand nationwide alliances, but in local elections <a href="https://www.nepalitimes.com/banner/local-government-by-the-people-for-the-people-of-the-people/" target="_blank" rel="noopener noreferrer">voters look at their own towns or cities</a> and decide who can best serve them,” explains social scientist Suresh Dhakal.Next month’s local elections will be the second under the federal system, and voters have had the past five years <a href="https://www.nepalitimes.com/banner/nepals-local-election-gives-power-back-to-people/">to judge the performance of mayors and municipality chairs</a>. If they have done a good job and are standing again, this time they may be rewarded with votes from supporters of other parties.The make-or-break issue in this election could be that there are 220,000 new young voters compared to 2017, with a total of 17,733,726 registered voters. While many of these Gen Z voters are expected to vote against established parties, they also tend to be disillusioned with politics and many do not vote.Which is why the predominant narrative against the main parties on the social web may not be reflected in <a href="https://www.nepalitimes.com/editorial/think-nationally-vote-locally/" target="_blank" rel="noopener noreferrer">voting patterns and election results.</a> Voters younger than 23 therefore need to analyse the performance of parties, and not just believe the campaign speeches of candidates.<a style="background-color: #ffffff; font-size: 15px; letter-spacing: 0.01em;" href="https://archive.nepalitimes.com/regular-columns/Between-the-lines/Bibeksheel-Nepali-work-post-earthquake-nepal,490" target="_blank" rel="noopener noreferrer">Alternative parties like Bibeksheel Sajha</a> targetted young voters and tried to imitate the success of the Aam Aadmi Party in India. However personality clashes within them, and their alignment with royalist-religious forces may turn many young voters off.“Despite all their problems, the established parties did<a href="https://www.nepalitimes.com/latest/is-democracy-too-expensive-for-nepal/" target="_blank" rel="noopener noreferrer"> struggle to restore democracy,</a>” explains political analyst Puranjan Acharya. “The so-called alternative parties turned out to be regressive and traditional.”The most dramatic change in forthcoming elections this year could be the <a href="https://www.nepalitimes.com/editorial/reward-performance/" target="_blank" rel="noopener noreferrer">confidence of women candidates for local governments</a>, as well as the empowerment of women voters throughout the country. Women who had been involved in community forestry user groups, drinking water supply, against domestic violence and other social issues are now active in local politics.“It is not just happening in urban areas, women are now much more aggressive at the grassroots and are demanding accountability from leaders,” says Suresh Dhakal.The 2015 Constitution mandated that the deputy mayor had to be a woman if the mayor was a man, and there had to be women and Dalit women members of elected ward councils.In 2017, many women voters said they cast their ballots for women candidates no matter which party they were from. Although this trend is expected to spread, there may be fewer women candidates this time because of the electoral alliances to field common candidates.There are now seven women mayors out of 293, and 19 female chairs of municipalities out of 460. Out of 6,743 wards, only 61 chairs are women. This shows that even though female membership of local councils has gone up, the executive positions are still predominantly male.Political analyst Indra Adhikari says that women have shown in the past five years that they can be <a href="https://www.nepalitimes.com/here-now/clean-up-elections-to-clean-up-politics/" target="_blank" rel="noopener noreferrer">accountable leaders</a> responsive to public needs, now they need to be re-elected to head at least one-third of the municipalities and wards,” she adds.Devolution expert Krishna Prasad Sapkota agrees: “The election of women to municipalities and wards has had a positive impact on local governance, parties have to be careful to include women candidates in their ticket list.”

Turning a new leaf in 2079

Today marks 18 years since 14-year-old Maina Sunar was <a href="http://archive.nepalitimes.com/blogs/thebrief/2015/02/17/remembering-maina/">detained and murdered by the Royal Nepal Army</a> in Panchkhal of Kavre District.At the peak of the Maoist War, Maina’s case became a symbol of the human rights violations perpetrated by both sides in the decade-long conflict. Nearly two decades later, her mother Devi is <a href="http://archive.nepalitimes.com/blogs/thebrief/2013/02/16/still-waiting/">still fighting for justice</a> for the extrajudicial killing of her daughter.Unable to access official channels, Devi has written an open letter asking Prime Minister Sher Bahadur Deuba to uphold rule of law and respect the Court’s decision.'My daughter would have been 33 this year. I had many dreams for her, as I am sure you do too about your son. Everything was robbed from me and my family. Although I won’t be able to bring my daughter back, and nothing could repair that loss, I want to see those responsible brought to justice,' the letter reads.Read also: <a href="https://www.nepalitimes.com/latest/nepals-unpunished-war-crimes/">Nepal's unpunished war crimes</a>, Sabita AdhikariShe continues: 'This will give a sense of security and hope, not only to me and my family, but also to hundreds of victims who suffered from similar losses during the armed conflict.'On 17 February 2004, an army patrol looking for Devi detained Maina and her brother for interrogation as a suspected Maoist. Soon after, she disappeared, never to return. Her brother was however sent back. For three years, Sunar’s family kept looking for Maina, having known that she was taken by the soldiers. <img width="400" height="406" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221114101124/637209a49c7e80680e0b5554jpeg.jpg" alt="">It was later revealed that Maina was <a href="http://archive.nepalitimes.com/issue/313/FromtheNepaliPress/12418#.Yg5Dse5Bz0s">electrocuted to death</a> on the same night as retribution for her mother Devi’s vocal criticism of the Army’s involvement in the murder of her niece, Reena Rasaili, accused of being a Maoist supporter.Under pressure from international rights groups, the Army set up a <a href="http://archive.nepalitimes.com/news.php?id=9966#.Yg5DxO5Bz0s">court of inquiry</a> to investigate the incident and the accused Colonel Bobby Khatri, Captain Sunil Prasad Adhikari and Amit Pun were sentenced to six months imprisonment, fined Rs50,000 and faced a ban on future promotions.But Devi did not think the punishment was commensurate with the crime and filed a case in the civil court. During this time, with help from the National Human Rights Commission (NHRC) and the United Nations Office of the High Commissioner for Human Rights (UNOHCHR), Maina’s body was exhumed from Panchkhal barracks.On 16 April 2017, after a thirteen-year-long legal battle, the District Court Kavre found three army officers guilty of murdering Maina but they have not been arrested or punished.Read also: <a href="https://www.nepalitimes.com/latest/still-missing-but-not-forgotten/">Still looking for dad missing in Nepa</a>l, Anita BhetwalIn her letter, Devi has questioned the existence of two commissions set up to investigate war crimes, the Disappearance Commission and the <a href="http://archive.nepalitimes.com/article/nation/conflict-victims-fear-TRC-only-serves-interests-of-state,2042">Truth and Reconciliation Commission</a> that have little to show in the way of delivering transitional justice.In fact, successive governments made up of former enemies the state has used the commissions to do their bidding and cover up their war crimes. Moreover, the Supreme Court’s order to amend the Transitional Justice Act mechanism is yet to be implemented.'Dear Prime Minister, I have promised my daughter that unless I bring those perpetrators to justice, I won’t rest. The remains of my daughter are still in the Teaching Hospital, and I am not able to perform her last rituals pending the implementation of the court’s decision,' concludes the letter. 'She would have been 33 this year'

One of my Chinese classmates asked me why the Nepal's communists used Mao in their party's name.She was troubled that China's revered leader had been turned into an icon for armed struggle and violence. My friend’s opinion was valid because even in Nepal, the very word ‘Maoist’ still instills fear in many Nepalis who witnessed the strikes, murders and kidnappings during the conflict decade.In fact, my classmate’s concern was in line with the Chinese government’s initial concern when the Maoist insurrection started. In early 2000s, <a href="https://www.voanews.com/a/a-13-a-2002-07-11-3-china-66291002/541200.html" target="_blank" rel="noopener noreferrer">China's Foreign Ministry Spokesman Liu Jianchao stated that the rebels had ‘usurped’</a> the name of Mao Zedong.Read also: <a href="https://archive.nepalitimes.com/article/nation/revisiting-maoist-demands,2860">What was it  all for? </a>  Om Aastha RaiMao had led the Communist Party of China to power in 1949 after years of violent struggle, he said, and China had no connection with the rebel group in Nepal. Ironically, the Chinese government labelled the Maoists in Nepal as ‘terrorists’ criticising them for being anti-government and bringing disorder to the country.In 2001, the Contemporary World magazine of the Communist Party of China International Department published a piece titled ‘Increasingly Active: Communist Party of Nepal (Maoist)’ which described the leaders as being solipsistic, neither able to create unity within the party nor with allies in other parties.The writer went on to claim that most Nepalis did not support the Maoists because the party was regarded as being ‘grossly out of touch with the reality in Nepal’ and even the international community hesitated to recognise it ‘because of their association with international terrorist organisations’.<figure><img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221114101124/637209789c7e80680e0b5544jpeg.jpg" alt="" width="679" height="404"><figcaption> </figcaption></figure>However, after 2006 when the Comprehensive Peace Accord was signed, the Chinese stance changed. The initial official reaction to Maoism in Nepal that used to be  fueled with skepticism and disdain, was replaced with a narrative that improved Mao’s own image.Prachanda (Pushpa Kamal Dahal) was suddenly seen as a trail- blazer against feudalism in Nepal. Some unbiased content still lives in academic literature by Chinese scholars, but the citations are not accessible anymore.The Communist Party of Nepal (Maoist) used Maoism as a suffix, instead of its main guiding principle. In fact, Mao Zedong himself was firmly opposed to using ‘Maoism’ as a political label for his ideology.<img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221114101124/637209799c7e80680e0b5545jpeg.jpg" alt="" width="1125" height="783">In a conversation with Wang Jiaxiang, a senior leaders of CPC, Mao said: "Maoism cannot be mentioned. I am a student of Marx and Lenin. How can I rank with them? Marx has Marxism, Lenin has Leninism, I cannot be labelled ‘Maoism'. I have no 'ism'. My ‘ism’ is Marxism and Leninism. You must mention Mao Zedong Thought. Everyone has their own thoughts. We can't casually mention 'ism'. I still believe that I haven't matured as a system of thought. It's not modesty, it's true."<a style="background-color: #ffffff; font-size: 15px; letter-spacing: 0.01em;" href="http://www.gov.cn/jrzg/2012-11/18/content_2269219.%20htm" target="_blank" rel="noopener noreferrer">According to the CPC constitution</a>, Mao Zedong Thought is ‘the application and development of Marxism-Leninism in China and the correct theoretical principles and empirical summary of China's revolution and construction proved by practice’.Read also: <a href="http://archive.nepalitimes.com/news.php?id=7642#.Yg20ie5Bz0s">Prachanda's family calls</a>, Nepali TimesIn 2013, a Chinese student published a paper titled ’Maoism in the eyes of Communist Party of Nepal' in Liaocheng University’s Social Science Journal identifying ‘Maoism’ as the suffix of the party's name, and was only a strategic choice under certain circumstances, not all of the party's actions were guided by ‘Maoism’.Nor had ‘Maoism’ proved to be able to guide its actions in parliamentary battles, the paper elaborated, describing the Maoists’ bottomless compromise with other political parties in Nepal as a violation of the basic principles of Marxism, and the party's division had a hand in this.<img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221114101124/6372097c9c7e80680e0b5546jpeg.jpg" alt="" width="680" height="478">The paper suggested that if Nepal’s Maoists wanted to adhere to the revolutionary line in future, they must adopt the basic principles of being a proletarian party and have new theoretical guidance to ensure that it will not degenerate into reformism.If there is one person Beijing decided to give attention to among Nepal’s Maoists, it was Prachanda. Although NCP (Maoist) received its fair share of criticism from China initially, the initial interviews with him by Chinese media tell a different story.In a <a href="https://news.ifeng.com/history/4/200703/0319_338_89975.shtml" target="_blank" rel="noopener noreferrer">detailed interview</a> with Global Times in 2007 soon after the ceasefire, Prachanda (Pushpa Kamal Dahal) was asked if he would run for president. He modestly replied that he would if the people and the party required him to. But he would do so only once and and after that lay low, be a member of the Party Central Committee and “slowly retire, read, write and do research”.A year later, the Maoists swept the election to the Constituent Assembly, and Dahal was elected prime minister. In a 2008 <a href="http://www.chinadaily.com.cn/hqzx/2008-05/27/content_6714355.htm" target="_blank" rel="noopener noreferrer">interview article featured in</a> China Daily, Dahal confessed that he was envious about how China dealt with Pu Yi (China's last emperor).He added: ‘If Gyanendra like Pu Yi becomes a commoner, it will be a blessing for the Nepali people.’The interviewer was impressed by Dahal’s simple lifestyle in Kathmandu, and the devotion of the people for him. He relates how when he arrived for the interview at 6AM there were already people waiting to see him. The interviewer says there was a ‘common phrase in Nepal that anyone can have a handshake with Prachanda’.China seems to tolerate Dahal despite his perceived incompetence because of the attachment of Mao’s name to his party, which carries China’s face. K P Oli, on the other hand, has been criticised in the Chinese media for allowing the split in the NCP and the UML.To be sure, Dahal has not tested the Chinese government’s patience like Oli has, but even the criticism Dahal receives within Nepal does not cross over to China, while Oli’s does. The Chinese government seems to be careful about any negativity towards CPN (Maoist) and manages news on him within China to save its own face.Dahal’s present predicament with the MCC in Nepal could either further improve or completely ruin his stature in China. State media here could have denounced Deuba and Dahal for their recently exposed secret letter to the MCC, but it was largely ignored.Dahal belongs to the Maoist Centre and signed the Belt and Road Initiative (BRI) – this seems to have made him immune to criticism in China. What the Chinese think about Nepal’s Maoists

She met others like her with missing parents, but had not given up the search.By then Nagma had completed her secondary education and was trying to decide on her career. But before long her only remaining support, her grandmother, died leaving her in charge of raising younger sister Swastika. But Nagma persisted and kept looking for her father on her own.She tried to visit top-ranking officials, joined the ‘Martyrs and Disappeared Warrior Children’ foundation and submitted a memorandum to the government to reveal the whereabouts of her missing father. But as her questions went unanswered and the state failed to investigate the case, her faith in the Disparaged Persons Committee started to erode. <figure><img width="1050" height="735" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221114101124/637209699c7e80680e0b553ejpeg.jpg" alt=""><figcaption> </figcaption></figure>She then turned to the Central Bureau of Investigation and studied for the Civil Service Commission exam with the hopes of joining the police force and finding her father herself. But as the sole earner of the family paying for both her and Swastika’s studies, she wasn’t able to keep up and did not sit for the paper.“Over the years I have often questioned myself if he was still alive. More than 15 years have passed, it has been a painful wait,” says Nagma, who strengthened her resolve once again and demanded that the government disclose information on the disappeared persons regardless of their state.After the peace talks in 2006, the Maoists became part of the government. The country went from the war to peace but the families of the disappeared continued to wait. None of the agencies set up to investigate war crimes are working on the whereabouts of nearly 1,500 still missing. <figure><img width="1050" height="662" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221114101124/6372096c9c7e80680e0b553fjpeg.jpg" alt=""><figcaption> </figcaption></figure>“If we don’t fight, the disappeared will also be forgotten,” adds Nagma, who is now with the organisation Voices of Women Media and is also affiliated with the Conflict Victim Women National Network. “The truth is missing just like those who were made to disappear.” What worries Nagma most is the fate of children affected by the disappearances during the conflict and says the Maoist-led government has treated them unfairly. Children of those declared martyrs get free of cost education up to any level but for the children of the disappeared, it stops at 18 years of age. She says: “As long as there is a hope of my father’s return, my search will continue. Still looking for Dad missing in Nepal

The hall at the Russian Cultural Centre in Kathmandu was packed, and the audience had overflowed into the aisles. As director, I should have been sitting on the front row. But I had another job that day: to stand next to the projectionist and at exactly 10 minutes 47 seconds, mute the film for 20 seconds. As directed by the military censors, this was to prevent the audience from hearing the narration: ‘A few days after <a href="http://archive.nepalitimes.com/news.php?id=6681#.YgimpChBzOQ" target="_blank" rel="noopener noreferrer">the Mangalsen attack</a>, the army arrived at the airfield and opened fire. Thirty-five people were shot dead. Among them were two children, labourers from other parts of Nepal, including 17 young men from Jogimara.’ As a film-maker I had never been trained to mute the sound track during a public screening. My eyes were glued not on the screen but on the digital time counter on the VHS player.https://www.youtube.com/watch?v=tA34vvNRsSgA year earlier, the Maoists had broken off peace talks and conducted simultaneous raids on army bases across the country. The government declared an emergency, and for the first time mobilised the Royal Nepal Army against the Maoists. Till then it was the police that was fighting the rebels.Today, we know from many countries that crackdowns on the free press in elected democracies can be more draconian than in authoritarian regimes. Twenty years ago, I faced proof of it in that dark auditorium. I was then with <a href="https://cijnepal.org.np" target="_blank" rel="noopener noreferrer">the Centre for Investigative Journalism Nepal (CIJ)</a>. Freed from day-to-day journalism, the job allowed me to look at the conflict in perspective, put the daily death tolls into context, and examine the human side of the war, and its impact on ordinary people.I was following the <a href="http://archive.nepalitimes.com/news.php?id=13920#.YgiiHChBzOQ" target="_blank" rel="noopener noreferrer">Kotbada massacre in Kalikot</a>. News reports were sketchy and contradictory. State media said ‘many terrorists’ had been killed at the under-construction airfield. Another news item buried in the inside pages said that among the ‘terrorists’ were 17 men from <a href="http://archive.nepalitimes.com/news.php?id=15172#.YgiiTShBzOQ" target="_blank" rel="noopener noreferrer">Jogimara in Dhading district</a>. An RSS report quoted MPs Prem Bahadur Singh from Kalikot and Rajendra Pandey from Dhading as informing the house that the dead were labourers constructing the airfield. <figure><img width="1486" height="1036" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221114101124/637209539c7e80680e0b5535jpeg.jpg" alt=""><figcaption> </figcaption></figure>My <a href="http://archive.nepalitimes.com/article/nation/should-journalists-job-extend-beyond-coverage,1881" target="_blank" rel="noopener noreferrer">journalist antennae</a> perked up. I heard from reporter Bhupraj Khadka that a family in Jogimara had conducted a funeral of one of the dead even though it had not received his body from the Army.As a film-maker, I felt this could be a way to portray the cruelty and senselessness of war. But there was an insurgency going on, and filming would be difficult and costly. I approached renowned documentary maker Dhruba Basnet, who had made the film रक्ताम्मे गराहरू (Blood-soaked Terraces) and we had worked together in many parts of Nepal.Rajendra Dahal, editor at Himal Khabarpatrika, offered to publish the story. In Jogimara, I met 15 of the 17 families who had lost their men in a massacre 500km at the other end of Nepal in Kotbada. The story came out in Himal, and Nepali Times <a href="http://archive.nepalitimes.com/news.php?id=5700#.Ygih3yhBzOQ" target="_blank" rel="noopener noreferrer">translated it in the issue #106</a> of 9-15 August 2002 (screenshots, below). This was a rare exposé of a conflict-era crime.We started working on the video footage, and were convinced it would be an important documentation of the tragedy. We had to do it on a shoe-string budget, and the film finally premiered at KIMFF 2002.There was pin-drop silence during the screening. From time to time, I could hear sobbing in the dark. But I had to concentrate on the approaching 10:47 on the VHS digital clock. At exactly 47 seconds, projectionist Sudarshan Karki muted the sound. The audience had been quiet till then, but I heard murmurs: “They’re censoring.” I had to have a ready answer in the remaining 32 minutes of the film, because the viewers were sure to have questions afterwards. <img width="1750" height="2448" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221114101124/637209569c7e80680e0b5536jpeg.jpg" alt=""><img width="2446" height="1096" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221114101124/637209599c7e80680e0b5537jpeg.jpg" alt="">King Gyanendra had just <a href="http://archive.nepalitimes.com/news.php?id=5416#.YgikPShBzOQ" target="_blank" rel="noopener noreferrer">sacked elected Prime Minister Sher Bahadur Deuba two months prior</a>, and had appointed Lokendra Bahadur Chand as prime minister. The emergency had been lifted, but now the palace and army were in charge.The Royal Nepal Army had got the district administration and Police Inspector Sukhdev Neupane of Kamal Pokhari station to stop the screening. Neupane called to say his bosses wanted to see the film. I replied that it was shot in a new format, and it would take time to convert. He said the police had state-of-the-art equipment in its tv studio and that wouldn’t be a problem.The police were not just trying to stop my film, but were putting pressure on KIMFF organisers Basanta Thapa and Kanak Mani Dixit to cancel the entire festival. They finally agreed on a compromise: show the film, but mute the parts the military found objectionable.When the screening started, I noticed soldiers in camouflage fatigues enter the hall. They had walkie talkies. When the film ended, there was stunned silence, then applause. The lights went up. I strode to the stage to answer audience questions, and the inevitable one: “Why was the film muted in the middle?”I had prepared my answer, but I saw the soldiers glaring at me from offstage. “The system was working, but it went off for a while,” I said, but could not muster the courage for the rest of my prepared answer: “But don’t ask me whether it was the sound system that was broken, or the country’s system.”I stepped off the stage, telling myself that when confronted with a formidable enemy, it is foolish to wage frontal warfare. It is better to outflank the adversary and go into insurgency mode. The censors had forced me to become a guerrilla film-maker. The 38-minute documentary went on to be a hit, with two additional screenings during the festival. Many wept openly. Basanta Thapa wrote later in Himal: “By trying to censor the film, have we been deprived even of the right to cry for our own country?” After KIMFF 2002, the Ministry of Communications imposed a <a href="http://archive.nepalitimes.com/news.php?id=4413#.YgikvChBzOQ" target="_blank" rel="noopener noreferrer">censorship rule on all film festival screenings</a>. Since then, there have been many governments that have come and gone in Nepal. Forbidden to remember the Kotbada massacre

<figure><img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/2022111410114/637205299c7e80680e0b289fjpeg.jpg" alt="" width="1208" height="737"/><figcaption></figcaption></figure>The first popularly elected government led by B P Koirala enacted the Birta Abolition Act in 1959, that required zamindars formerly granted land by the state to pay full tax. <a href="https://www.nepalitimes.com/banner/america-nepal-and-the-royal-coup/" target="_blank" rel="noopener noreferrer" data-saferedirecturl="https://www.google.com/url?q=https://www.nepalitimes.com/banner/america-nepal-and-the-royal-coup/&amp;source=gmail&amp;ust=1643077045608000&amp;usg=AOvVaw2B7iXxi6EQ44Yn6fvU7P8o">Feudal landlords opposed the move</a>, and it became one of the reasons why King Mahendra ousted Koirala in a coup d’etat on 12 December 1960.<a href="https://www.nepalitimes.com/here-now/land-reform-in-cold-war-nepal/" target="_blank" rel="noopener noreferrer" data-saferedirecturl="https://www.google.com/url?q=https://www.nepalitimes.com/here-now/land-reform-in-cold-war-nepal/&amp;source=gmail&amp;ust=1643077045608000&amp;usg=AOvVaw0_lFjeM84k9XkhIFJ4Ij_i">B P believed that only genuine land reform</a> would ensure that all Nepalis prospered together, and also deflect the Communism tide. But in <a href="https://www.nepalitimes.com/latest/putsch-ek/" target="_blank" rel="noopener noreferrer" data-saferedirecturl="https://www.google.com/url?q=https://www.nepalitimes.com/latest/putsch-ek/&amp;source=gmail&amp;ust=1643077045608000&amp;usg=AOvVaw3728k40jtTzbzquYVdgXVu">justifying his coup</a>, Mahendra declared that Nepal’s first democratically elected government had to be overthrown because it had “failed to work in the interest of the poor”.Today, more than six decades later, BP’s Nepali Congress that espoused social democracy is leading a governing coalition. <a href="https://www.nepalitimes.com/banner/dance-of-democracy/" target="_blank" rel="noopener noreferrer">Sher Bahadur Deuba</a>, who once led the party’s student union, is prime minister for the fifth time.Yet, 1.5 million families representing a quarter of Nepal’s households, are still landless or have land issues. Some 53% of Nepal’s farmers own only 18% of the total cultivable land.After ousting B P, King Mahendra continued the भुमी सुधार land reform to retain international support and quell domestic discontent. But the effort was half-hearted: the landed kept their land. Mahendra and his son <a href="https://www.nepalitimes.com/here-now/if-birendra-was-alive-nepal-would-still-be-a-monarchy/" target="_blank" rel="noopener noreferrer">Birendra</a> ruled through a partyless Panchayat system for the next 30 years.Ironically, unequal land ownership (the very reason that pushed Mahendra to stage his coup) became one of the factors that led to the People’s Movement and the downfall of the Panchayat in 1990.But even after the multi-party system was restored, there was only tokenism for land rights. In 1991, a commission set up to resolve the issue was dissolved even before it could complete its work. In the past three decades, 18 more land reform commissions have been formed by democratic governments, only to fizzle out.Land ownership and rights have been weaponised time and again at election time since 1990 to win votes, but there has been no real change on the ground. The Nepali Congress, UML and Maoists are all guilty of making false promises to the landless.The Maoists made land to the tiller and just land distribution a major point in their 40-point demand to Deuba in 1996 during his first tenure as prime minister. Their main slogan to recruit young men and women to take up arms was to promise land.After all this, the landless have stopped trusting politicians who promise land. Disputes over land make up one-third of all cases in Nepal’s courts.Various factors have changed the dynamics of land today. While educated Nepalis do not want to farm and <a href="https://www.nepalitimes.com/editorial/high-risk-remittance/" target="_blank" rel="noopener noreferrer" data-saferedirecturl="https://www.google.com/url?q=https://www.nepalitimes.com/editorial/high-risk-remittance/&amp;source=gmail&amp;ust=1643077045608000&amp;usg=AOvVaw0fa06zRhqJSxyBT6Zn3rB4">migration is leaving arable land fallow</a>, remittances fuel the market in real estate, the price of which has risen exponentially.This unorganised and uncontrolled buying and selling of land has once again concentrated ownership in the hands of richer Nepalis, who have grown pheonmenally richer as property values escalate. There is a whole class of new-rich who have made their fortune through real estate speculation.This is why we have the farce of the Baluwatar real estate scandal that involves the mightiest in the land, even while a quarter of the country’s population is landless.The Gorkha empire’s expansion in the 18th century was financed by land, generals and soldiers were granted ownership of portions of the land they conquered. During the Shah reign, the royalty and courtiers could take what they wanted. During the Rana period, at least one-third of the total cultivable land in Nepal was distributed among those close to them. The Birta system may have been repealed six decades ago, but it is still intact in other forms through landlords, traders and brokers owning most property.Real estate today is booming business, and a major source of revenue for the state from taxes. <a href="https://www.nepalitimes.com/here-now/kathmandu-creeps-up-surrounding-mountains/" target="_blank" rel="noopener noreferrer" data-saferedirecturl="https://www.google.com/url?q=https://www.nepalitimes.com/here-now/kathmandu-creeps-up-surrounding-mountains/&amp;source=gmail&amp;ust=1643077045608000&amp;usg=AOvVaw1sT_kl8lVvxjzEaQecolxh">Urban land value appreciation</a> has made it possible for some Nepalis to become fabulously rich overnight.It is not productive when real estate speculation becomes a mainstay of the economy. It does not create jobs, and it exacerbates inequality. Private property rights effectively legitimise past injustices that parcelled out large swathes of the country to the privileged. It perpetuates discrimination and inequality, laying the seeds for future conflict.To be sure, distributing land to the landless alone does not solve their problem, nor does it erase historical discrimination. Self-respect comes from belonging to the land, giving them a sense of purpose and responsibility. It is a start. Ground reality of landlessness in Nepal

<figure><img width="2250" height="3149" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221114091156/637203509c7e80680e0b2800jpeg.jpg" alt=""/><figcaption>Illustration: SWORUP NHASIJU</figcaption></figure>On 26 January, Nepal will elect 20 members to the National Assembly to replace those  retiring from the Upper House following the end of their four-year terms, marking the beginning of the second series of elections under the federal system. Leaders of the governing five-party coalition have already divided up the 19 electable seats amongst themselves, and appointed their nominees – making it certain they will win. The <a href="https://www.nepalitimes.com/latest/tis-the-season-of-conventions-in-nepal/" target="_blank" rel="noopener noreferrer">general conventions </a>of three of Nepal’s biggest and most influential parties in the last months, which were mini elections unto themselves, marked the beginning of campaigning for <a href="https://www.nepalitimes.com/here-now/all-eyes-on-2023/" target="_blank" rel="noopener noreferrer">local and federal elections</a> in the coming year. All major parties including the <a href="https://www.nepalitimes.com/latest/nepali-congress-party-time/" target="_blank" rel="noopener noreferrer">Nepali Congress</a> (MC), <a href="https://www.nepalitimes.com/latest/post-convention-uml-eyes-set-on-elections/" target="_blank" rel="noopener noreferrer">UML</a> and the Maoist Centre (MC) retained their gerontocracies.Preparations are now underway for local elections, which the Election Commission has recommended should be held on 27 April across the country. Nepal conducted its first legislative assembly elections as a multiparty system in 1959. Since then, there have been 10 elections for the National Legislature, with the 2017 general elections being the first of its kind after the country ushered in federalism. The year also marked the first time sub-national elections were held in 20 years.There were 14.2 million ballots cast during local elections in May 2017. However, the number jumped to 15.4 million in provincial and parliamentary elections in November the same year. Read also: <a href="https://www.nepalitimes.com/here-now/all-eyes-on-2023/" target="_blank" rel="noopener noreferrer">All eyes on 2023</a>, Mukesh PokharelIn March 2021, the Election Commission stopped voter registration and published an updated list of 16.2 million voters after former Prime Minister <a href="https://www.nepalitimes.com/latest/oli-sweeps-uml-party-polls/" target="_blank" rel="noopener noreferrer">K P Oli</a> dissolved Parliament and announced early elections. The registration process resumed after the Supreme Court reinstated the house in July.And right after the Election Commission announced the National Assembly polls in November, it also announced the beginning of a month-long special voter registration program during which an additional 600,000 Nepalis registered.  As elections approach, Nepal’s political discourse is already dominated by <a href="https://www.nepalitimes.com/editorial/volatile-mix-of-politics-and-religion/" target="_blank" rel="noopener noreferrer">parties stoking nationalistic and religious fervour</a>.  This has made for surprising political partnerships, with the Hindu-right and leadership from self-proclaimed ‘alternative’ parties uniting in their rejection of federalism, secularism and even republicanism.And if their <a href="https://www.nepalitimes.com/latest/unconventional-party-conventions/" target="_blank" rel="noopener noreferrer">general conventions </a> were any indication, the parties will use this rhetoric to vilify opponents and gain voters at the expense of issues most pertinent to the people, such as education, migration, healthcare, the economy and the pandemic. <img width="960" height="640" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221114091156/637203539c7e80680e0b2801jpeg.jpg" alt="">In an ideal democracy, elections force public officials to be accountable. Candidates are elected based on promise of performance. But in Nepal, the polling system itself lacks transparency -- right from election funding. But electoral reform measures like re-demarcation of constituencies based on population, polling systems and voting rights of diaspora Nepalis who cannot cast votes in person, remain neglected.There has been much back and forth about the demarcation of election constituencies. While Article 286 (5) of Nepal’s Constitution states that the delineation should be done on the basis of population and geography, Madhes-based activists have pressed for constituencies to be divided on the basis of the population only.Read also: <a href="https://www.nepalitimes.com/editorial/battle-lines-drawn-for-nepal-elections/">Battle lines drawn for Nepal elections</a>, EditorialThe government formed a five-member Constituency Delimitation Commission to look into possible rearrangement of constituencies for the federal and provincial elections in July 2017. The commission demarcated constituencies by giving 90% weightage to population size and 10% to geography.Govind Subedi, a professor of population studies at Tribhuvan University, has argued that recent practices have gone in the ‘wrong direction’. He writes in his book Political Demography of Nepal: 'The uneven distribution of representatives … is likely to increase if we adopt a population-size only-method [of delineation] … it can have a far-reaching implication in the geo-polity of Nepal.'Subedi, who was an adviser to the Commission, continues: ‘It is more likely that the sparsely populated districts in provinces which lie in the western mountains and the far western region will feel regional imbalances in sharing of political power in the national polity, which in turn may lead to provincial conflicts in the years to come.’Furthermore, Nepal’s election laws are lax enough that the wealthiest in the country who previously bankrolled parties in exchange for personal, professional and policy favours have<a href="https://www.nepalitimes.com/here-now/purchasing-power/" target="_blank" rel="noopener noreferrer"> entered politics themselves</a>. The number of businessmen and contractors elected into leadership in 2017 proves that money, not political competency, decides who is ultimately elected to lead. Read also: <a href="https://www.nepalitimes.com/latest/is-democracy-too-expensive-for-nepal/">Is democracy too expensive for Nepal?</a>, Laxmi BasnetIndeed, the First Past the Post (FPTP) system has become a hotbed for corruption by businessmen, thus undermining democracy, say election experts. Prominent leaders from across the political aisle, particularly women elected into office like Minister for Women, Children and Senior Citizens Uma Regmi, have spoken in support of an overhaul of Nepal’s current election system into a fully proportional electoral system after having experienced firsthand how the current system <a href="https://www.nepalitimes.com/here-now/the-business-of-politics/" target="_blank" rel="noopener noreferrer">benefits the rich, powerful and the establishment</a>, while they are burdened with election debt long after they have left office.Former Acting Chief Commissioner of the Election Commission Dolakh Bahadur Gurung says that the reform should be such that MPs are not allowed to become ministers, and term limits must be set so that the same people do not hold on to their seats until they are 90 years old. ‘Our Constitution has been amended a fair number of times,’ wrote Gurung in October, ‘it is not impossible to reform our electoral system.’Meanwhile, the debate about mailed ballots and absentee voting has gained much traction among the <a href="https://www.nepalitimes.com/editorial/the-year-of-migrant-workers/" target="_blank" rel="noopener noreferrer">Nepali diaspora</a> in recent years. An estimated 4 million Nepalis work, study and live in India, the Gulf, Malaysia, Japan, Korea, Europe and North America.The Supreme Court issued a directive to facilitate voting for Nepali diaspora across the world in March 2018. However, successive governments have shown no interest in ensuring voting rights for millions of eligible voters living overseas.And even as the government has begun to <a href="https://www.nepalitimes.com/latest/its-in-the-mail/" target="_blank" rel="noopener noreferrer">expand the reach of its archaic postal service</a> by delivering items like passports to people’s homes, it has not considered postal voting to keep the service relevant. The political establishment seems to fear that Nepalis in the Gulf and Malaysia are fed up with the government back home, and allowing them to vote by mail will be predominantly anti-incumbent.  The Sweden-based International Institute for Democracy and Electoral Assistance (IDEA) says 151 of 216 countries around the world allow voters living abroad to cast ballots in some capacity. According to the Election Integrity Project, 40 countries used postal ballots in their most recent national election before the Covid outbreak.Nilkantha Uprety, the former Chief Election Commissioner, believes there are two options to eliminate election irregularities. Clean up elections to clean up politics

President Bidya Devi Bhandari, Prime Minister Sher Bahadur Deuba, Nepal Army Chief Prabhu Ram Sharma, Chief Justice Cholendra SJB Rana, House Speaker Agni Sapkota and Deputy Mayor of Kathmandu Hari Prabha Khadgi at Indra Jatra this week. </figcaption></figure>More than two months after Prime Minister Sher Bahadur Deuba <a href="https://www.nepalitimes.com/latest/deuba-5/" target="_blank" rel="noopener noreferrer">took office</a> to lead a five-party coalition, he has not even been able to form a complete Cabinet. He was thought to have <a href="https://www.nepalitimes.com/editorial/deubas-denouement/" target="_blank" rel="noopener noreferrer">amassed a lot of experience</a> in coalition bargaining during his previous five tenures as prime minister.
But this time, he is having a difficult time untangling the knots within knots within the alliance. First, he has had to <a href="https://www.nepalitimes.com/latest/old-wine-in-old-bottle-in-nepal-politics/" target="_blank" rel="noopener noreferrer">divide up ministerial portfolios</a> among his coalition partners which turned out to be a major hurdle.
After the government was formed in mid-July, Deuba’s Nepali Congress (NC) and the Maoist Centre (MC) divided up the powerful finance, energy, home and law ministries among themselves. He then appointed a loyalist to be state minister of health, and on Wednesday he had to hurriedly appoint Narayan Khadka as foreign minister to represent Nepal at the United Nations General Assembly. Khadka was named, sworn in by the president, assumed office and departed for New York all within 12 hours.
The <a href="https://www.nepalitimes.com/latest/what-is-delaying-nepal-cabinet-expansion/" target="_blank" rel="noopener noreferrer">ministerial appointments had been stalled</a> because Upendra Yadav of the Janata Samajbadi Party had wanted the post, which he has held twice before, for himself. However, Deuba appears to have finally got all four parties who want their members in the Cabinet to agree on a quota: eight each of the NC and MC, and 6 each for the JSP and the UML (US) of Madhav Kumar Nepal.
However, this still leaves the question of <a href="https://www.nepalitimes.com/latest/who-gets-what/" target="_blank" rel="noopener noreferrer">which party gets which of the remaining ministries</a>. Predictably, the JSP and the UML (US) want the ministries with the biggest budgets: education, agriculture, transport and physical infrastructure. Since this is going to be a coalition that will oversee elections in 2023, the parties all want ministries with either power, or money, or both.
A Cabinet meeting on Tuesday decided abruptly to recall 12 ambassadors, including those to the US, UK, India and China appointed by KP Oli when he was prime minister. All are political appointees, and among the envoys being recalled is Deuba’s own mother-in-law Pratibha Rana in Tokyo.
Analysts say one reason for this purge of ambassadors is to offer plum posts for further bargaining to mollify <a href="https://www.nepalitimes.com/editorial/they-fail-we-fall/" target="_blank" rel="noopener noreferrer">coalition partners</a> not satisfied with their allocated ministerial portfolios. Deuba also has to contend with ministership demands from within his own NC, especially his rival Ram Chandra Paudel’s faction.
There has been outrage and ridicule in social media and from commentators about Prime Minister Deuba adding ministers in installments. Former prime minister Oli, who was ousted by Deuba, has been the most scathing in his criticism.
The prime minister’s job is not easy. He had to suspend Parliament in the middle of the budget session in July so that he could pass an ordinance amending the Constitution to allow parties to split if they commanded only 20% of the membership of their parliamentary party. But that ordinance, which needs to be ratified by Parliament within 60 days, has now become an albatross around Deuba’s neck.
Madhav Nepal of the UML (US) on whose behalf <a href="https://www.nepalitimes.com/latest/nepals-post-breakup-politics/" target="_blank" rel="noopener noreferrer">the party split ordinance</a> had been introduced so he could legally break away from Oli’s UML, is now worried that if it is not ratified his new party will not have legal standing. Nepal is also nervous about a writ filed in the Supreme Court by Oli, and if a verdict makes his party split unconstitutional.
Yadav of the JSP, meanwhile, wants the ordinance scrapped before Cabinet expansion so that disgruntled members of his own party who do not get their preferred ministerships do not break away.
Coalition members had said Cabinet expansion would happen on Wednesday, but negotiations appear to have stalled because of Madhav Nepal and Upendra Yadav wanting different things for their own partisan reasons.
